Customer Terms and Conditions
Effective Date: 11/06/2026
1. Introduction
Welcome to [Website Name] (“Marketplace”, “we”, “us”, or “our”).
The Marketplace is an online platform that connects customers with independent jewellery artisans and makers (“Vendors”). By accessing or using the Marketplace, you agree to these Terms and Conditions.
2. Marketplace Role
The Marketplace acts solely as an intermediary platform connecting customers and Vendors.
Products listed on the Marketplace are offered and sold by independent Vendors. The Marketplace does not manufacture, own, inspect, or directly sell the products listed unless specifically stated otherwise.
3. Product Information
Vendors are responsible for providing accurate descriptions, specifications, dimensions, materials, and images of their products.
While we encourage accuracy, the Marketplace does not warrant that all product information is complete, accurate, or error-free.
As many products are handmade, slight variations in appearance, finish, colour, size, or detailing may occur.
4. Pricing
All prices displayed on the Marketplace are determined by individual Vendors.
Prices may be changed at any time before purchase.
Applicable taxes, duties, or shipping charges may be added during checkout where applicable.
5. Orders
Submission of an order does not guarantee acceptance.
Vendors reserve the right to decline or cancel orders due to:
- Product unavailability
- Pricing errors
- Suspected fraud
- Circumstances beyond their reasonable control
Customers will be notified if an order cannot be fulfilled.
6. Shipping and Delivery
All shipping and delivery arrangements are managed by the Vendor.
Estimated delivery times are provided as guidance only and are not guaranteed.
The Marketplace is not responsible for delays caused by couriers, customs authorities, weather events, strikes, or other factors beyond reasonable control.
7. Returns and Refunds
Return and refund policies may vary between Vendors.
Customers should review the Vendor’s stated policies before purchasing.
Where required by applicable consumer protection legislation, Vendors must comply with their legal obligations.
8. Handmade Nature of Products
Products sold through the Marketplace are predominantly handmade or artisan-crafted.
Minor variations, tool marks, natural inclusions, or slight differences between photographs and delivered products should not be considered defects where they are consistent with handcrafted manufacture.
9. Limitation of Liability
The Marketplace shall not be liable for:
- Product defects
- Delivery failures
- Vendor conduct
- Customer disputes
- Indirect or consequential losses
Any claims relating to a product should first be directed to the Vendor responsible for the sale.
10. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
